It&#039;s actually pretty simple, whenever a law and the constitution are in disagreement, the constitution wins.

The only exception occurs when the state demonstrates a vested interest in curtailing or limiting the freedoms guaranteed in our constitution.

The couples in the case successfully demonstrated the harm done to them via this law, and the state failed to refute that.</description>
