The proposed amendment to Indiana’s constitution to ban same-sex marriage failed to make it out of the House Rules and Legislative Procedure Committee, which effectively kills it for the year. As with Arizona’s defeat of a similar measure, the hangup was with the second part of the proposed amendment which would have effectively banned other forms of partnerships or recognitions similar to marriage — including many protections enjoyed by unmarried heterosexual couples.
We’ve seen clauses similar to this used in attempts to overturn domestic violence laws in Ohio, strip Michigan employees of health insurance, and more recently, to try to deny hospital visitation rights to unmarried couples in Minnesota.

In 2005, the Southern Poverty Law Center wrote that “[Paul] Cameron’s ‘science’ echoes Nazi Germany.” What the SPLC didn”t know was Cameron doesn’t just “echo” Nazi Germany. Anti-gay activists often charge that gay men and women pose a threat to children. Along with companies such as Eli Lilly, the pharmaceutical maker; E.I. Cummins, a diesel engine manufacturer; Wellpoint Health Networks; Dow AgroSciences; and Emmis Communications, which helped considerably, as well as input from some state universities.

It should also be noted that the House committe will undoubtably reconsider SJR-7 in the next session. If passed out of committee, the greater House will surely pass it, which puts the amendment on the 2008 ballot. Such an amendment will likely be passed by the electorate.
Were the “2nd sentence” which affects the ‘legal incidents of marriage’ removed the House committee would have passed the amendment out. The democrats wanted to strip the amendment down to just that, a heterosexual definition of marriage. But the republicans refused to do it because the clock would have been restarted on such an amendment and the earliest it could be voted on would be 2010.
There are evidently a number of revenge tactics going on in the Indiana General Assembly since SJR-7 didn’t pass muster. A number of bills are now getting superfluous amendments that deal with abortion. One would create a licensure program for “Termination of Pregnancy Specialists” with a number of requirements including a $20,000 lincensing fee (See BILERICO).
