Rumors about veto of Portugal’s marriage law

Some news sources are reporting that Portuguese President Anibal Cavaco Silva intends to veto the same-sex marriage bill passed by the legislature. (gayopolis)

Portuguese President Anibal Cavaco Silva will veto a gay marriage bill approved by lawmakers in February, Radio Renascenca reported. Cavaco Silva will veto the bill soon after Pope Benedict’s arrival on May 11.

However, both the President and the legislative leadership are denying that any decision has been announced. As yet, the exact method by which the bill will become law is uncertain. The legislature has adequate votes to overturn a veto and has indicated intention to do so.

He only has until the 28th to sign or veto. May 11th would be well past that deadline.

Does Portugal have a pocket veto provision?

Can the bill become law after a certain period of time if the President doesn’t sign it?

That would be the perfect option for him.

According to tvi24 the decision of the Constitutional Court will be published in the Official Gazette later this week and the deadline for signing the bill into law starts with this official publication. So president Cavaco Silva will have until 19th or 20th of May to sign it.

If he decides to veto the bill, parliament can overturn the veto by voting again.

it says “Cavaco Silva deverá tomar a decisão logo após a visita do Papa …” = he will decide … and the article looks to me as if it just offered the journalist’s opinion on how the president should decide. Disclaimer: I don’t speak Portuguese, but I know French and a little Latin and Italian.
