Iowa Judge Finds Gay Marriage Ban Unconstitutional

iowa.gifAP is reporting that Iowa is the next state to find that marriage cannot be restricted based on the sex of the participants. 

Judge Robert Hanson has ruled that Iowa’s prohibition on same-sex marriage is unconstitutional. He ordered the Polk County recorder’s office to issue marriage licenses to gay couples.

This advances the issue to the Iowa Supreme Court.

Romney bashes Iowa judge for striking down ban on gay marriage

“The ruling in Iowa today is another example of an activist court and unelected judges trying to redefine marriage and disregard the will of the people as expressed through Iowa’s Defense of Marriage Act,” Romney said in a statement issued by his campaign. “This once again highlights the need for a Federal Marriage Amendment to protect the traditional definition of marriage as between one man and one woman.”

Whenever I hear “Activist Judge” I take it as shorthand for the speaker saying “I never paid attention in social studies class and have no idea of the structure of our government.”

The state and federal constitutions supercede any and all laws.
It’s actually pretty simple, whenever a law and the constitution are in disagreement, the constitution wins.

The only exception occurs when the state demonstrates a vested interest in curtailing or limiting the freedoms guaranteed in our constitution.

The couples in the case successfully demonstrated the harm done to them via this law, and the state failed to refute that.
