The Ninth Circuit Court of Appeals has denied the standing of the deputy clerk of Imperial County to appeal Judge Walker’s decision in Perry v. Schwarzenegger.
The district court order denying the motion to intervene is AFFIRMED. Movants’ appeal of the district court order concerning the constitutionality of Proposition 8 is DISMISSED for lack of standing.

Waiting to hear how soon it will be that 8’s defenders will accuse the judges of being corrupted, especially the judge known to be more liberal.
How long will it be before someone from NOM or ADF and so on, will cry unfair that that Walker started all this and FORCED them back into court to appeal.
How long will they say that Boies and Olson were such bullies in the courts that THEY didn’t allow 8’s supporters to really speak effectively?

There were two appellants asking the court to give them standing to appeal the judge’s decision:
The Proponents – the creators of Proposition 8.
Imperial County’s supervisors and deputy clerk.
The idea is that to appeal, one has to be directly impacted by the decision. The Proponents are exactly impacted, so they tried to bring in the deputy clerk of imperial county to say that her job makes her impacted because she’s the one who passes out the marriage licenses and files them.
The Ninth said that Imperial County has no real standing.
But they punted to the CA Supreme Court on the Proponents.

I’m sorry for posting this here but, I am a gay man and former career Navy man.
I think we gays should be able to laugh at ourselves and not take things so personally. The Navy Captain who is in jeopardy of losing his Career or at the very least his Command is NOT the enemy of Gay people.
I haven’t seen the video, and I doubt that it was leaked for the reason purported. I think some Sailor of the Enterprise sent a copy to show his wife or buddy or whomever, and from there it became a tool of the Anti-Freedom Religious Right who started this huge “tizzy” about gays being slurred in the videos produced by this Captain.
It’s my opinion that we gays SHOULD SUPPORT this Captain and help him to NOT loose his career nor his command. This is such a trivial thing, and to make one man a scapegoat for the politically correct IS AN INCORRECT THING TO TOLERATE.
PLEASE RISE-UP AND HELP THIS CAPTAIN DEFEND HIS HONOR. Show the US Government that we are not looking for a savior to crucify. Let’s tell the Navy to give this man back HIS Command and his life.

He was just trying to insert a little humor into a very tense situation. And I think this Captain deserves our respect in saying HE is NOT the PROBLEM. The problem is when the US Government tries to LEGISLATE CONTROL OVER (and/or ruin) the life and make a sacrificial lamb of ONE single citizen.
Come-on Gay, rise up and defend the rights of a single person versus the establishment.

JandyA, I think you need to find another venue to post your opinion about the Navy Captain. This is a thread about the marriage equality laws, not about an unbelievably unprofessional and embarrassing attempt at bathroom humor by a military officer who should know a lot better than to use official resources to produce juvenile videos that would inevitably show up in the civilan media.
As a retired Navy officer myself, I’m just disgusted that senior military officers still think that officially sanctioned insult humor is funny. But that’s a subject for another thread.

Hadn’t noticed this fact (due to the trolling Navy Captain remark misplaced here) but it isn’t a county clerk defending Prop 8, it is an Assistant County Clerk, the actual County Clerk did not desire to be a part of this circus, so it leads to the question of whether a subordniate has standing.
It’s akin to “Joan, the receptionist, will be defending Prop 8”

JandyA first this is not the right place to post that. and second, the man was fired because he had horrendous videos with not just anti-gay slurs and nasty fictional situations he had blatantly unprofessional videos which the navy felt was a poor reflection on the people in command.
