Our Huge Yet Limited Victory

BOTTOM LINE: The federal government will now recognize same-sex marriages from states that allow such marriages, and California now joins that list . The California decision is based the premise that the private party who defended Prop 8 in court had no standing to do so. The decision does not establish whether or not there is a Constitutional right to such marriages for all citizens.

Update: I’ve corrected the last sentence: “The decision does not establish…” Thanks to those who brought that to my attention.

You probably meant:

This is huge not just because the decisions will have immediate positive impacts but also because the DOMA decision appears to be broad enough to mean the court will eventually rule the rigt way on marriage.

Not quite right. The decision only addresses the standing issue in the APPEAL, not the actual trial. The Judge Walker’s decision stands.
