    They’re only “activist” judges when the decision isn’t the one you like.

    Wow, Herbert must have worked overtime on that one — he managed to work in not only “activist judge” but “the will of the people” as well.

    Do you suppose Brian Brown wrote it?

    I think Judge Shelby was quite eloquent. “It is true that the people of Utah voted to pass Amendment 3. It is also true that the 14th Amendment of the Constitution was ratified by the states and is now part of the federal law that governs this entire country, including state constitutions.”
