Indian court reinstates colonial era sodomy law

A colonial-era law criminalising homosexuality will remain in effect in India, a top court said, dealing a blow to gay activists who have argued for years for the chance to live openly in India’s deeply conservative society.

The Supreme Court threw out a 2009 New Delhi High Court decision that struck down the law as unconstitutional, saying it was for lawmakers – and not the courts – to decide the matter.

This is a serious set-back for rights in India.

Sadly, as current as we sometimes think India is (so much of our tech comes from there), we need to remember that they have not evolved politically or socially as quickly as other nations. They’ll catch up, and the courts will come along with the societal upgrade. There will come a time when the Indian populace looks back on this decision as Americans look back at Dred Scott.

Young (straight) Indians are protesting the ruling by posting pictures to facebook of themselves kissing people of the same sex.

Slacktivism for sure, but certainly not something you could imagine happening in America after Bowers v. Hardwick was announced, so the times are changing even if the Indian Supreme Court hasn’t caught up.
