Who’s trying to buy an election while pulling the wool over the eyes of Maine voters?

As the campaign in Maine enters the home stretch, our skeevy opponents have unleashed yet another ad claiming that unless marriage equality is overturned, same-sex marriage will be “pushed” on elementary school children.
Our side has responded with calm, rebutting the attacks with facts, statements from authoritative figures, and appeals to higher values. Sadly, that approach has been condemned by well-respected figures in our community, including Andrew Sullivan, Mike Tidmus, the Box Turtle Bulletin and the Bay Area Reporter.
Condemned? Hardly. I think there’s a big difference between condemnation and constructive criticism. That said, I do remain concerned that Protect Marriage Equality is playing defense rather than controlling the parameters of debate. Stand for Marriage Maine’s Frank Schubert has made Question 1 not about marriage equality, but about education. We have the opportunity to turn the election about something else, and that’s fairness. Not just fairness for LGBT families, which I believe most voters really don’t have a vested interest in (like they do with education). But fairness in terms of the caliber of debate carried out by our opponents. Nobody likes to be duped, and that’s exactly what Stand for Marriage Maine is trying to do. That, and buy an election outright. Is that what Mainers really want?
I plan on returning to this topic more fully in a later post, hopefully tomorrow or Tuesday. On the positive side, let me repeat this: Protect Maine Equality is doing an amazing job with their grass-roots effort, perhaps the best I’ve seen yet. So read Matt’s piece and donate or volunteer today. Remember, the rule is still in effect: people who sit on the sidelines have no right to criticize.

For several weeks over the past three months, my job has taken me to the Four Corners area of New Mexico on the Navajo Indian Reservation. While there, I’ve gotten a small, tentative peak at small snippets of Navajo culture from among my co-workers, the first thing being that they don’t call themselves Navajo. Instead, they call themselves Diné, which just means “The People.” The second thing I learned — and I know this runs the danger of indulging in meaningless stereotypes — is that on the whole, the Diné are a very friendly and humorous people. I am by no means an expert on Native American peoples, nor have I done much extensive traveling on Indian lands, but of the tribes and reservations that I have come in contact with, the Diné have a very different vibe about them. They are both proudly Diné and proudly American. The Diné language is a flourishing, living language, Diné land is breathtakingly beautiful, and all in all — to this outsider at least — there just seems to be this sense of belonging and permanence. That sense that the Diné are here, they’ve always been here, and they will be here forever.
My last business trip happened to coincide with the Northern Navajo Fair, held annually in Shiprock, New Mexico. It’s sort of like a state fair for the Navajo reservation. Since Shiprock was about an hour away from where I was working, and I was going to have to work through the weekend, I decided to take a Saturday evening off and make the two-hour drive to get there. That’s one hour to get to Shiprock, and another hour in traffic through that small town to park and walk to the fairgrounds. I mentioned my plans to one of my Diné co-workers. He smiled and said, “I don’t know. You might yourself surrounded by Indians.”
I did say the Diné have a great sense of humor, didn’t I?
Well, I went and had a great time. The fair itself is much like any other state or county fair. There was a midway with rides, typical fair food of funnel cakes, sausages, and turkey legs, carnies hawking games and other merchandise, livestock and horticulture exhibits, 4H and Future Farmers of America events. And a rodeo, a staple of all fairs in the American West.
And there was dust, dust like you can’t imagine. Gather thousands of people to walk around a few acres of desert, and you will stir up a fine dust that hangs in the air like a giant tan cloud. For that weekend, the Shiprock fairgrounds were without a doubt The Dustiest Place On Earth.
But of course, since this was the Navajo fair, there were several differences from your typical state fair. A traditional Pow-wow was taking place in one corner of the fairgrounds, a series of Diné community singing and dancing contests were held in a central pavilion, and just off the garishly-lit midway was a more humble, dimly-lit area of traditional Diné food vendors. While their operations were considerably simpler than the flashing lights of the corndog trailers, they had at least one huge advantage over their outside competitors: The Diné vendors constructed tents or simple plywood shelters to shield their diners from the dust.
Now each the sheltered areas were typically small, large enough to hold maybe four or five folding tables, which for me presented a small problem because I was feeling conspicuously White. I felt a great deal of trepidation about going into one of those small tents by myself, a White guy interloping among several Diné families enjoying dinner. But I found one vendor which was mostly empty, and so I decided to try that one.
It turned out to be a good choice. This vendor had arranged her tables differently from the others. Her tables were arranged in a U-shape, with diners sitting on the outside of the “U” facing the center. Since I was the only one there, I sat at the bottom of the “U” and gave her my order of roast mutton in frybread and a bottle of water. Soon after I sat down, several others joined me: an elderly couple on the leg of the “U” to my left, and a family of dancers later came in and sat along the leg of the “U” to my right. When my food arrived, two middle-aged sisters sat down to my immediate left, and an elderly gentleman crowded in to my right. Before I knew it, we had a full house.
With the configuration of the tables where everyone is facing everyone else, conversation naturally came easily. And I saw right away how foolish I was to feel out of place. The lady to my left immediately struck up a conversation with me and told me about the things I should see at the fair. She also insisted that I try the Navajo Tea, a traditional tea brewed from the Greenthread herb. So while I was sipping the tea, the elderly gentleman was telling me about himself, his late wife, his son in college, and, of course, the fact that “Navajo” is what White people call them, and that they call themselves Diné. Which I already knew, but I nodded respectfully as one would do for one’s elders, and I carefully inserted the word Diné in my conversation whenever it was appropriate to do so. Meanwhile, the lady at my left explained the grand finale performance that everyone was there to see later that night.
To give you a little bit of background, the fair begins the weekend before with a nine day healing ceremony known as the Ye\’ii Bi Chei Ceremony. It is a series of dances performed continuously by several groups of dancers. The Ye\’ii Bi Chei culminates with a grand-finale on the last Saturday night of the fair, that very same Saturday night that I happened to there. But because the Ye\’ii Bi Chei finale was scheduled to begin at 10:00 p.m. and I was looking at another two-hour drive to get back to the hotel and going to work the next day, I wasn’t able to attend. So that’s one reason why there aren’t any pictures of it. But the other, much more important reason is that photography is strictly forbidden due to the sacred nature of the ceremony.
But as I said, there was so much more to see and experience. So after everyone had finished eating and we took our leave of each other, I walked over to the central pavilion where the singing and dancing contests were being held. Those I could photograph, even though all I had on me was my cell phone. Since taking snapshots is what tourists do, I played my part. Then I pocketed my phone and just stood and watched.
Now I know we’ve all heard “Indian music” in the movies. It’s typically performed as a high-pitched wail set against the beating of a drum. Diné music, in those respects, is no different — at least superficially, and my untrained ears aren’t capable of going beyond the superficial. And when this music is performed in the movies, we White folks can only take so much of it before it becomes annoying. Maybe that’s why they keep those scenes short.
But I noticed something very different as I stood at the edge of the pavilion and listened as groups and families got up to chant and drum, while others gathered to dance in a slow circle. When you hear the drums beating with you right there, they take on the characteristics of a heartbeat. Maybe not literally, and I have no idea whether that’s what they’re intended to do, but they appear as natural and essential as a beating heart, accompanying the groups as they chanted their songs.
And what amazing songs they are. Every other performance I’ve ever attended, I’ve heard what sounds like a consciously planned, written and rehearsed performance, with a beginning, a middle, and an end. And they come off as well-rehearsed — or maybe not so well-rehearsed, as the case may be. But when you go to a concert, that’s generally what you pay to see. And here too, I also witnessed what must have been carefully rehearsed performances as well — these are groups singing in perfect unison, not individuals making it up as they went along — but it didn’t sound like it.
Instead, these songs sounded as if they were not made by human effort, but were the reflection of something much larger, both inside and outside the singers. It’s like the songs welled up from the dusty ground, pushed their way through the singers’ throats, burst forth from out of their mouths and into the cool night air, and swirled up to the stars and the full moon that shined down on the fairgrounds that night. And the songs themselves don’t feel like they are confined to the moment in which they are performed. Instead, they seem to transcend time, never beginning nor ending. They remain permanent, as permanent as the Diné themselves. And all the while there is the steady beat, beat, beat, steady and strong like a heart. Like the world’s heart, giving life to the crisp autumn night, and cutting through the dust and the noise of the carnival barkers and the DJ playing Pitbull’s Calle Ocho off in the distance. It cut through all of that because the Diné are here, they’ve always been here, and they will be here forever.
I pulled my cell phone back out of my pocket and called my partner back home. “Chris,” I said, “you’ve got to hear this…”

In a statement, the company said that approving R-71 “ensures that basic benefits and important protections are not taken away from committed couples, so they are able to take care of each other, especially in times of crisis.” Starbucks wants voters to approve the measure “because it is aligned with our business practices, providing domestic partner benefits, and one of our core values of treating people with respect and dignity.” [emphasis in SLOG’s post]
Starbucks hasn’t contributed to the campaign, but they did send this message out to their employees. Starbucks has 3,000 employees in its Seattle headquarters and maintains 667 stores in Washington state, and each of them got this statement. That’s quite a venti.
Starbucks’ endorsement follows similar appeals from Microsoft, Boeing, Nike, and many other companies that employ large numbers of people in the Pacific Northwest.
With all the attention being paid to Maine, Washington’s LGBT citizens are feeling ignored. Karen Ocamb says they’re sweating bullets because they may well lose their hard-won Domestic Partnerships. Please show them your love by donating to Approve Ref. 71 today.

The Bangor Daily News reports that Stand for Marriage Maine, the group pushing to strip LGBT Mainers of their right to marry, has almost doubled its war chest in the past three weeks. They raised $1.4 million in October, bringing their total amount raised to $2.6 million, according to reports filed Friday with the Maine Ethics Commission. Guess where the money came from:
But $1.1 million of the $1.4 million raised by Stand for Marriage Maine in October came from a single source: the National Organization for Marriage. In fact, the Washington, D.C., organization has bankrolled more than 60 percent of the campaign to ban same-sex marriages in Maine.
The No on 1 campaign, meanwhile, claims to have received contributions from more than 22,000 donors, compared to slightly more than 700 donors to the opposing camp.
This brings NOM’s total investment to $1.5 million, according to the Associated Press. By my calculations, that’s actually 58% of the total. But still, that’s pretty amazing. One out-of-state special interest group is trying to purchase an election, lock, stock and barrel. The Roman Catholic Diocese of Portland has contributed a total of $550,000 to the “yes” campaign. Another $114,500 came from Focus On the Family. Together, these three groups alone account for 83% of Stand for Marriage Maine’s total budget.
And yet, despite the fact that the National Organization for Marriage is paying the lion’s share of the bill, they are in court demanding that they be held above Maine’s financial disclosure laws:
NOM\’s financial role in the Maine campaign will be discussed in federal court in Portland on Monday when a judge hears arguments in a complaint the group filed against the state.
Earlier this month, the Maine Ethics Commission voted 3-2 to investigate whether NOM was skirting campaign finance laws in order to avoid disclosing the identities of contributors. A complaint against NOM alleges the organization, which played a key role in overturning California\’s gay marriage law last November, funnels money to Stand for Marriage Maine while promising donors confidentiality.
NOM responded earlier this week by challenging the constitutionality of Maine\’s law requiring “ballot question committees” to file detailed campaign finance reports.
Meanwhile, campaign finance reports also show that Protect Maine Equality has raised more than $4 million so far. This includes $1.4 million raised in October, matching Stand for Marriage Maine’s fundraising from the same period. While the nearly 80% of the Yes side’s money during that period came from NOM, most of Protect Maine Equality’s fundraising came from individual donors during the same period.
Protect Maine Equality also reports some large donors, but nothing like the outright attempted purchase of an entire campaign by NOM. According to the Bangor Daily News, Portland resident Donald Sussman has contributed more than $500,000. The Human Rights Campaign kicked in $220,000 in donations and in-kind goods and services, and the National Gay and Lesbian Task Force has contributed about $140,000 in funds, goods, and services.
Altogether, these three major donors make up only 22% of Protect Maine Equality’s total take. The rest, as they say, comes from people like you. Please donate today.

Yesterday’s installment of CitizenLink gives a little more insight into the recent announcement that the Exodus International will take over the lead role from Focus On the Family for planning, producing and promoting the “Love Won Out” ex-gay conferences. That transfer of responsibilities also appears to signal a significant cutback in the scale and frequency of these conferences. According to Melissa Fryrear, who had served as director of the events:
Exodus will scale down the event and not offer as many sessions or include as many speakers. They will, however, add sessions designed to more fully equip churches generally and pastors specifically.
She also said that the next Love Won Out event will be March 6 in San Diego, and another one will be announced in the Fall. This pace is down sharply from years past, when they normally would schedule about six Love Won Out conferences in various cities per year. Fryrear will continue to be a part of the conferences, serving as the keynote speaker.

The Advocate asks, “Best Buns Contest Too Public?”
A gay rodeo\’s “best buns contest” has elicited a complaint from a Sacramento-area resident who lives across the street from the venue where the event took place, according to KCRA.com. Monty Stanley of Wilton, Calif., said the October 17 show, which was sponsored by the Capitol Crossroads Gay Rodeo Association as a fund-raiser for Shriners children’s hospitals, was in plain view from his driveway.
“They had more than best buns,” Stanley told KCRA. “They had everything out there naked, and you can see it plain as day. What I witnessed there and what you saw on that camera is not different than pornography.”
Stanley stood in his driveway and shot video of the event, which he made available to KCRA. On the night of the rodeo event, his teenage daughter had several friends over at the house, and Stanley said they all witnessed the contest as well.
The event’s organizers deny that anything other than buns were displayed. But still, I think a good rule of thumb is this: If you’re having a best buns contest and someone can see those buns from clear across the street and in their own driveway, then yes. It’s too public.

It’s not all bad. Judge Memorial Catholic High School in Salt Lake City Catholic will go forward with its production of Rent, after the school’s superintendent reviewed the play at the request of the Bishop:
Sister Catherine Kamphaus, superintendent of schools in the Salt Lake City diocese, said she read the script at the request of Bishop John Wester, and she watched a dress rehearsal Tuesday.
“There is absolutely nothing that would be offensive,” Kamphaus said Thursday. “It wasn’t condoning the gay and lesbian lifestyle.”
Rather, she said, the play shows friends forming a loving and caring community while facing AIDS and other challenges. …The superintendent praised Judge’s use of the play as a springboard to teach about the Roman Catholic Church’s compassion for outcasts, the sick and the hopeless.
A special school edition of Rent bcame available in the past year. The school edition removes one song, “Contact,” along with profane language.

And their reactions are true to form — full of all the same bald-faced lies we’ve heard before. Fortunately, this should be their second-to-last gasp. The last one will come when President Barack Obama signs the legislation into law. First up, Tony Perkins, of the Family “Research” Council:
“In a slap to the face of our servicemen and women, they attached ‘hate crimes’ legislation to the final defense bill, forcing Congress to choose between expanding hate crimes or making our military go without. This hate crimes provision is part of a radical social agenda that could ultimately silence Christians and use the force of government to marginalize anyone whose faith is at odds with homosexuality. … We call on President Obama to veto this legislation which violates the principle of equal justice under the law and also infringes on the free speech rights of the American people.”
The Family “Research” Council really needs to bone up on their research skills, because right there in the text of the bill (Section 4311) are these clauses:
3) FREE EXPRESSION- Nothing in this division shall be construed to allow prosecution based solely upon an individual\’s expression of racial, religious, political, or other beliefs or solely upon an individual\’s membership in a group advocating or espousing such beliefs.
(4) FIRST AMENDMENT- Nothing in this division, or an amendment made by this division, shall be construed to diminish any rights under the first amendment to the Constitution of the United States.
(5) CONSTITUTIONAL PROTECTIONS- Nothing in this division shall be construed to prohibit any constitutionally protected speech, expressive conduct or activities (regardless of whether compelled by, or central to, a system of religious belief), including the exercise of religion protected by the first amendment to the Constitution of the United States and peaceful picketing or demonstration. The Constitution does not protect speech, conduct or activities consisting of planning for, conspiring to commit, or committing an act of violence.
So unless the “planning for, conspiring to commit, or committing an act of violence” is an essential element of Christian speech, people of faith have nothing to worry about.
Next up, we have Traditional Values Coalition Executive Director Andrea Lafferty. She also repeats the false claim that “Christians and other people of faith will now become targets for persecution and prosecution,” but adds this bit of creativity:
Hate crime legislation is based on the phony premise that there\’s an epidemic of hate in America against LGBT (gays, bisexuals, lesbians and transgendered) persons. This is false. FBI hate crime statistics prove that most so-called hate crimes amount to little more than name-calling or pushing or shoving.
First of all, the FBI doesn’t collect statistics for “name-calling, pushing or shoving.” They only collect statistics on violence and credible threats of violence. But that’s not the only whopper she told. Of all the hate crime categories that the FBI tracks, hate crimes based on sexual orientation are much more likely to be violent personal crimes than any other category.

There are more. Bob Unruh at WorldNetDaily calls the bill “the Pedophile Protection Act,” an obvious play on the “thirty sexual orientation” lie, which we dissected last May. All in all, there’s at least one thing you can say about these anti-gay activists: they may not be truthful, but they are consistent.

Recently the Guam legislature introduced legislation that would create same-sex domestic partnerships. That move prompted this response from the Archdiocese of Agana (Guam) (PDF: 261KB/3 pages):
The culture of homosexuality is a culture of self-absorption because it does not value self·sacrifice. It is a glaring example of what John Paul II has called the culture of death. Islamic fundamentalists clearly understand the damage that homosexual behavior inflicts on a culture. That is why they repress such behavior by death. Their culture is anything but one of self-absorption. It may be brutal at times, but any culture that is able to produce wave after wave of suicide bombers (women as well as men) is a culture that at least knows how to value self-sacrifice. Terrorism as a way to oppose the degeneration of the culture is to be rejected completely since such violence is itself another form of degeneracy. One, however. does not have to agree with the gruesome ways that the fundamentalists use to curb the forces that undermine their culture to admit that the Islamic fundamentalist charge that Western Civilization in general and the U.S.A. in particular is the “Great Satan” is not without an element of truth. It makes no sense for the U. S. Government to send our boys to fight AI Qaida and the Taliban in Afghanistan, while at the same time it embraces the social policies embodied in Bill1SS (as President Obama has done). Such policies only furnish further arguments for the fundamentalists in their efforts to gain more recruits for the war against the “Great Satan.”

A coalition of twenty-two Ugandan professional and civil rights advocacy groups have joined together to denounce (PDF: 52KB/4 pages) the barbaric Anti-Homosexuality Act of 2009 that was introduced before Parliament last week. The Civil Society Coalition on Human Rights and Constitutional Law describes the bill as not just an “anti-homosexuality” bill, but also as “the ‘Anti Civil Society Bill,’ the ‘Anti Public Health Bill,’ or the ‘Anti-Constitution Bill,'” or more specifically, “the Anti Human Rights Bill.” And they liken the bill’s measures with some of the more repressive practices of the Idi Amin era.
The coalition points out eight specific constitutional articles which the proposed bill violates, and a long list of people who would be put at risk of serious criminal penalties should the bill pass. This list includes not only LGBT people themselves, but also parents, teachers, landlords, doctors, human rights activists, religious counselors, publishers, and even Internet cafe operators.

In sum, the Bahati Bill is profoundly unconstitutional. It is a major stumbling block to the development of a vibrant human rights movement in Uganda, and a serious threat to Uganda\’s developing democratic status. If passed, this law would not only prove difficult to implement, it would also consume resources and attention which would be better directed at more pressing issues of human rights abuse, corruption, electoral reform, domestic relations and freedom of the press.
Regardless of our personal moral beliefs and values, we the undersigned organisations are standing up in defence of Democracy, our Constitution and its enshrined principles of human dignity, equality, freedom and justice for all.

The Senate passed the Matthew Shepard Hate Crimes Prevention Act today on a 68-29 vote. The act will now go to President Barack Obama, who has promised to sign the bill into law.
The bill extends federal protections to people who suffer violent crimes because of their sexual orientation or gender identity, protections which are already afforded to people who are victims of violent crimes because of their race, religion, or national origin.
Passage of the hate crimes measure came on a bipartisan vote, with ten Republicans joining 56 Democrats and two independents to pass the bill. One Democrat, Sen. Russ Feingold (D-WI) voted against the measure, which was attached to a defense policy bill. Sen. Feingold said he supported the hate crimes provision but opposes the open-ended military commitment in Afghanistan.
The Matthew Shepard Foundation has released this statement by Judy Shepard:
Dennis and I are extremely proud of the Senate for once again passing this historic measure of protection for victims of these brutal crimes,” said Judy Shepard, president of the Matthew Shepard Foundation Board. “Knowing that the president will sign it, unlike his predecessor, has made all the hard work this year to pass it worthwhile. Hate crimes continue to affect far too many Americans who are simply trying to live their lives honestly, and they need to know that their government will protect them from violence, and provide appropriate justice for victims and their families.”
By voting overwhelmingly to extend to these often-targeted Americans our nation\’s decades-old bias crime legislation, senators sent the message that hate crimes will not go unpunished, and local governments and law enforcement agencies will not run out of financial resources to provide justice to these victims and their loved ones.
…The Matthew Shepard Foundation applauds Congress and President Obama for their steady and successful efforts throughout 2009 to bring the legislation to this point. We eagerly anticipate its final enactment and wish to thank the countless organizations and individuals who have worked tirelessly for its passage.

Senior Chief Petty Officer Michael Toussaint
The Navy announced yesterday that the chief petty officer responsible for sexually provocative hazings of junior sailors in Bahrain will be forced to retire in January, two years earlier than planned. He will also receive a letter of censure from the Secretary of the Navy, which the Virginia Pilot describes as “the harshest administrative action that can be taken against a sailor.”
Adm. Gary Roughead, the chief of naval operations, opted to cancel Toussaint’s final years of service. Roughead “found that the incidents were not in keeping with Navy values and standards and violated the Navy’s longstanding prohibition against hazing,” according to Smith. “Our sailors are to be treated with dignity and respect in a healthy and positive working environment.”
One victim, former Petty Officer 3rd Class Joseph Rocha, said he was subjected to repeated slurs about his sexuality after he refused to have sex with female prostitutes.
Petty Officer 1st Class Shaun Hogan submitted detailed notes about Toussaint’s abuse during more than two years under his command. Hogan told the Navy lawyer who originally handled the case that Toussaint routinely made inappropriate comments about and inquiries into sailors’ sex lives, and threatened to revoke sailors’ dog-handling credentials if they crossed him.
Hogan also described Toussaint’s directing the filming of training videos that required some sailors to act out lesbian love scenes, others to simulate gay male sex and one to have rubber balls thrown at his crotch, all in a guise of running the dogs – trained to sniff out explosives – through various “real life” scenarios.

With this move, Toussaint avoids a court martial. Joseph Rocha reacts:
“A lot of us are disappointed in that Toussaint won\’t see his day at a military court martial,” Rocha said. “But overall, I commend the CNO and the Secretary of the Navy for a wanting to look further into this, to see how widespread the corruption was.”
An unnamed commanding officer originally decided to handle the situation by issuing Toussaint a nonpunitive letter of reprimand. Rocha, who is gay went on to officer training, but left the Navy with Post Traumatic Stress Disorder over the harassment. Later, he met a reporter with Youth Radio and told his story. Youth Radio broadcast a powerful series of investigative reports into the incidents, many of which were picked up on National Public Radio.
